The passport is an essential document for international travel. Always check validity of your passport: it should be valid at least until your return date to Brazil. If you are visiting a country that requires a visa (e.g.: USA, Australia, etc.), the minimal validity period is 6 months.

Discretionary Powers of the Border Police.

Dear Sirs,

President Carlos Alberto Amorim Ferreira has shown concern about recent events involving Brazilian citizens in some countries of the European Community and consequently, with ongoing claims, seeking to sympathize with travel agencies in possible legal actions of the referred Boarder Police, and has therefore determined that Legal Counsel provide a legal position to submit to members, resulting in the following advice.

This is not the first time that Legal Counsel sustains the inexistence of supportive responsibility between the intermediary service provider and air transport service providers due to contractual blame of the latter and, more rightly so, tourist agencies should not be indicated as supportive of the discretionary acts of border authorities.

This would be to take the consequences of a civil crime too far.

There must be proof of the damages caused by the causal nexus of the act vitiated as illegal.

In a recent case, the Supreme Court of Justice of Brazil, * A.I nº 876.646.- MG (2007-0042163-7), Minister Aldir Passarinho Junior correctly understood, as claimed by this Legal Counsel, that the tourist agency is not responsible for discretionary acts of Border Police agents. - Attached document - *see trial proceedings in the Supreme Court of Justice website.

As the issue is repetitive and inexhaustible in this judgment, ABAV advises travel agencies that intermediate air ticket sales to take the following precautions:

1. NOTIFY IN WEBSITE, BROCHURES, CONTRACTS AND ANY OTHER FORM IN AN UNMISTAKABLE MANNER THAT: "travelers should carry their documents in order, present or comply with requirements of the country they are visiting and present entrance visa when requested".

2. ALSO NOTIFY TRAVELERS THAT ALTHOUGH THEY ARE CARRYING ALL DOCUMENTS AND VISAS, the Border Police may, as a discretionary act, deny the entrance of any citizen.

Travel agencies undertake to notify and prepare their defense of eventual liabilities for material and moral losses and damages, as EXCULPATORY OF THIRD PARTY RESPONSIBILITY.

RETENTION OF PREVIOUS PASSPORT WITH EXPIRED VISAS:

After a request for a new passport/new model, the Federal Police is retaining the previous passports of applicants that do not contain valid visas. Consequently, we advise all applicants to take AUTHENTICATED copies of the old passport before requesting a new passport and handing the old passport to the Federal Police.

It should be noted that presentation of the authenticated copy or of the previous visa and pages 01, 02 and 03 of the previous passport or the original passport with the visa is mandatory to revalidate visas for the USA. Failure to present an authenticated copy or original passport will result in the need to schedule an interview, without the privileges awarded to those who have already obtained a visa that expired less than 01 year ago.

Moreover, the Canadian Consulate always requests copy of previous Canadian visas.
